1. General Provisions

1.1 Scope of Application:

  • These terms apply to the use of the Pangea Ink website, services provided at our studio, purchases of products online or in-store, and loyalty programs.

1.2 Modifications:

  • Pangea Ink reserves the right to update or modify these terms at any time without prior notice. Changes will take effect immediately after being posted on our website or official platforms.

1.3 Acceptance of Terms:

  • By using any service from Pangea Ink, you confirm that you have read, understood, and accepted these terms and conditions in full.
  • If you do not agree to these terms, you must not use our services or products.

1.4 Language of Agreement:

  • This document is drafted in English. In case of interpretation or disputes, the reference language will be English.

2. Services and Products

2.1 Appointments

  • Appointments must be scheduled in advance, either in person, by phone, email, or through our online platforms.
  • Deposits:
    • A non-refundable deposit is required to secure your appointment, with the amount depending on the type of service requested.
    • In the event of cancellation, the deposit will not be refunded but may be transferable if the rescheduling request is made at least 48 hours in advance.
    • Failure to attend your appointment or cancellations made with less than 48 hours’ notice will result in forfeiture of the deposit.
  • Late Arrivals:
    • A 15-minute grace period will be provided for late arrivals. After this time, the studio reserves the right to cancel the session, and the deposit will not be refunded.

2.2 Changes and Rescheduling

  • Changes to appointments must be requested at least 48 hours in advance.
  • Only one rescheduling per deposit is allowed. Additional changes will require a new deposit.

2.3 Tattoos and Piercings

  • Pangea Ink reserves the right to refuse service if the client:
    • Does not meet hygiene standards.
    • Shows signs of being under the influence of alcohol or drugs.
    • Requests a design that infringes on copyright, is offensive, or violates studio policies.
  • Clients must be at least 18 years old to get a tattoo or piercing. Minors require written consent from a legal guardian accompanied by valid identification.

2.4 In-Store Purchases

  • All product sales (jewelry, flashes, merchandise) are final. No returns or exchanges are allowed, except for defective products.

  • Tattoo flashes are sold exclusively to the client purchasing them.
  • Once purchased, the design cannot be replicated for other clients.

2.6 Promotions and Discounts

  • Promotions are only valid on the specified dates and conditions.
  • Discounts cannot be combined unless otherwise stated.

3. Hygiene and Safety

3.1 Hygiene Standards:

  • Pangea Ink follows strict sterilization protocols to ensure the safety of all clients.
  • All instruments used are disposable or sterilized in compliance with international health standards.

3.2 Client Responsibilities:

  • Clients must:
    • Arrive for their session clean and well-rested.
    • Inform staff of any medical conditions, allergies, or recent treatments that may affect the procedure.
    • Follow the aftercare instructions provided by the artist or piercer.

3.3 Risks and Liability Waiver:

  • Although all necessary precautions are taken, tattoos and piercings are invasive procedures and carry certain risks, including infections, allergic reactions, or irregular healing.
  • By undergoing a procedure at Pangea Ink, the client assumes these risks and releases the studio from liability for complications resulting from failure to follow aftercare instructions.

3.4 Right to Refuse Service:

  • Pangea Ink reserves the right to refuse service if the client’s condition or the requested design is deemed inappropriate.

3.5 Minors:

  • Procedures for minors require the presence and written authorization of a legal guardian, who must sign a liability waiver.

4. Intellectual Property

4.1 Ownership of Content:

  • All content on the Pangea Ink website, including but not limited to designs, artwork, images, and text, is the intellectual property of Pangea Ink and its artists.

4.2 Prohibited Use:

  • Unauthorized use, reproduction, distribution, or alteration of Pangea Ink’s content is strictly prohibited.
  • Designs created by our artists are for personal use only and cannot be duplicated, sold, or used commercially without explicit consent.

4.3 Client’s Designs:

  • For custom designs requested by clients, Pangea Ink retains the right to reproduce, share, or use the artwork for promotional purposes unless explicitly agreed otherwise.

4.4 Flashes and Artwork Purchases:

  • Once purchased, tattoo flashes are exclusive to the client and will not be replicated or sold to others.

5. Payments and Refunds

5.1 Payment Policy:

  • Full payment for services and products must be made at the time of booking or purchase.
  • Accepted payment methods include cash, credit/debit cards, and approved online payment systems.

5.2 Deposits for Appointments:

  • Deposits are required to secure an appointment and are non-refundable.
  • Deposits may be transferable if rescheduling occurs within the required 48-hour notice period.
  • Deposits will be forfeited if the client fails to show up or cancels with insufficient notice.

5.3 Refund Policy:

  • Services: Refunds are not issued for services (e.g., tattoos or piercings) under any circumstances.
  • Products: Refunds are only provided for defective merchandise after inspection and approval.
    • Defective items must be reported and returned within 5 business days of purchase.
    • Products showing signs of misuse or damage caused by the client will not qualify for a refund.

5.4 Gift Cards:

  • Gift cards are non-refundable and cannot be exchanged for cash.
  • Gift cards are valid for the specified time period, if applicable, and must be used before the expiration date.

6. Privacy Policy

6.1 Data Collection:

  • Pangea Ink collects personal information, such as name, contact details, and service preferences, for the purpose of providing services.

6.2 Use of Data:

  • Your personal information will only be used to:
    • Book and confirm appointments.
    • Provide updates regarding services or promotions.
    • Improve our services and client experience.

6.3 Third-Party Disclosure:

  • Pangea Ink will never share your personal information with third parties without your explicit consent, except when required by law.

6.4 Client Consent:

  • By using our booking system or subscribing to updates, you consent to the collection and use of your personal information as outlined in this policy.

6.5 Security:

  • We implement measures to protect your data. However, no system is completely secure, and Pangea Ink cannot guarantee absolute protection against breaches.

7. Dispute Resolution

7.1 Jurisdiction:

  • Any disputes, claims, or disagreements related to Pangea Ink services or products will be governed by the laws of Panamá.

7.2 Resolution Process:

  • Clients are encouraged to address any concerns directly with Pangea Ink’s management to seek an amicable resolution.
  • If an issue cannot be resolved informally, both parties agree to pursue mediation or arbitration before considering legal action.

7.3 Limitations of Claims:

  • Any claims against Pangea Ink must be filed within 30 days of the incident or service date.

8.4 Rules and Conditions:

  • Stamps are earned with each completed service.  
  • Cards are service-specific and cannot be combined.  
  • Discounts and rewards apply only after reaching the required stamps.  
  • Stamps cannot be transferred between cards or exchanged for cash.  
  • Pangea Ink reserves the right to verify stamp eligibility and modify the program at any time.

10. Client Responsibilities

10.1 Behavior and Conduct:

  • Clients are expected to behave respectfully toward staff and other customers.
  • Any form of harassment, offensive language, or disruptive behavior will result in refusal of service and potential removal from the premises.

10.2 Preparation for Appointments:

  • Clients must ensure they:
    • Arrive on time for their appointment.
    • Are clean and sober (free from the influence of drugs or alcohol).
    • Have eaten and are hydrated to avoid fainting or other complications during the procedure.
  • Failing to meet these requirements may result in the session being rescheduled or canceled, and the deposit will be forfeited.

10.3 Disclosing Medical Information:

  • Clients must disclose any medical conditions, such as:
    • Allergies (to latex, ink, metals, etc.).
    • Skin conditions (eczema, psoriasis, etc.).
    • Bloodborne diseases or disorders (e.g., hemophilia).
    • Pregnancies (for piercings or tattoos near the abdomen).
  • Failing to disclose such conditions may increase the risk of complications and release Pangea Ink from liability.

10.4 Follow Aftercare Instructions:

  • Aftercare instructions will be provided after each session, and it is the client’s responsibility to follow them to ensure proper healing.
  • Pangea Ink is not liable for infections, allergic reactions, or complications arising from improper aftercare or failure to follow the instructions provided.

11. Liability and Risk

11.1 Acknowledgment of Risk:

  • By choosing to undergo a tattoo or piercing at Pangea Ink, the client acknowledges and accepts the potential risks associated with the procedure, including but not limited to:
    • Pain, discomfort, or bleeding during the procedure.
    • Swelling, redness, or scarring during the healing process.
    • Potential allergic reactions to materials used (e.g., ink, needles, jewelry).
    • Infection if aftercare instructions are not followed.

11.2 Release of Liability:

  • Pangea Ink will not be held responsible for:
    • Adverse reactions due to undisclosed medical conditions.
    • Complications arising from external factors, such as improper aftercare or misuse of jewelry.
    • Changes in the appearance of tattoos or piercings due to aging, weight fluctuations, or other natural factors.

11.3 Service Results:

  • Tattoos and piercings are creative and biological processes, and as such, results may vary.
  • Clients understand that:
    • Ink colors may heal differently depending on skin tone and type.
    • Piercings may close if jewelry is removed prematurely.
    • Touch-ups for tattoos may be necessary and are subject to additional fees unless otherwise specified by the artist.

12. Gift Cards and Promotions

12.1 Gift Cards:

  • Gift cards are non-refundable and cannot be exchanged for cash.
  • Gift cards are valid only for services or products at Pangea Ink.
  • Any remaining balance on a gift card will not be refunded but can be applied to future services or purchases.

12.2 Promotional Offers:

  • Promotions, discounts, and offers are valid only for the period and conditions specified.
  • Promotional discounts cannot be combined with other offers unless explicitly stated.

12.3 Event-Specific Discounts:

  • Pangea Ink may run limited-time promotions for events or holidays. These are subject to availability and are not guaranteed to apply to all services or products.

13. Health and Safety Standards

13.1 Sterilization and Hygiene:

  • Pangea Ink adheres to the highest sterilization and hygiene standards to ensure the safety of clients and staff.
  • All needles and equipment used during procedures are sterile, single-use, and disposed of immediately after use.

13.2 Health Certifications:

  • All Pangea Ink staff members are trained and certified in health and safety procedures, including first aid and infection control.

13.3 Client Responsibilities:

  • Clients are advised to avoid procedures if they are feeling unwell, recovering from recent illnesses, or have open wounds near the tattoo or piercing site.

14. Termination of Services

14.1 Refusal of Service:

  • Pangea Ink reserves the right to refuse service to anyone for reasons including but not limited to:
    • Disrespectful or abusive behavior toward staff or other clients.
    • Arriving under the influence of alcohol or drugs.
    • Failure to follow studio policies or procedures.

14.2 Breach of Terms:

  • Any violation of these terms and conditions may result in termination of services and exclusion from future participation in Pangea Ink programs or activities.

14.3 No Refund for Refused Services:

  • In cases where service is refused due to client behavior or failure to meet requirements, deposits and payments will not be refunded.

15. Aftercare Policies

15.1 Tattoo Aftercare:

  • Detailed aftercare instructions will be provided to every client after their tattoo session. General guidelines include:
    • Keep the tattoo covered for the first few hours (as advised by the artist).
    • Wash the tattoo gently with warm water and mild, fragrance-free soap.
    • Avoid scratching, picking, or exposing the tattoo to direct sunlight or water (e.g., swimming pools, hot tubs) during the healing process.
    • Apply recommended ointments or moisturizers as instructed.

15.2 Piercing Aftercare:

  • Aftercare instructions will be provided for each specific piercing. General guidelines include:
    • Clean the piercing site with a saline solution twice daily.
    • Avoid touching or rotating the jewelry unnecessarily.
    • Do not remove or change the jewelry prematurely (follow the timeline provided by the piercer).
    • Avoid swimming, saunas, and hot tubs during the healing process.

15.3 Touch-Ups and Follow-Ups:

  • Tattoos: One complimentary touch-up session may be offered for tattoos that show fading or incomplete healing within the first three months, provided aftercare instructions were followed. This does not apply to tattoos on areas prone to fading (e.g., fingers, palms).
  • Piercings: Follow-ups for any concerns or adjustments to jewelry are encouraged. Replacement jewelry or additional services may incur a fee.

15.4 Client Responsibility:

  • Failure to follow aftercare instructions may result in complications, including infections, scarring, or fading. Pangea Ink is not liable for such outcomes.

16. Photography and Social Media

16.1 Photography Permission:

  • By receiving a service at Pangea Ink, you consent to the studio taking photographs or videos of your tattoo or piercing for promotional and portfolio purposes.

16.2 Client Rights:

  • If you do not wish for your images to be used on social media or promotional materials, please inform the artist or management in writing before or during your session.

16.3 Sharing by Clients:

  • Clients are encouraged to share their experiences on social media. When posting photos of tattoos or piercings from Pangea Ink, crediting the studio and artist is appreciated.

16.4 Studio Social Media Policies:

  • Pangea Ink maintains an active presence on platforms such as Instagram, Facebook, and Google Maps. Clients are welcome to engage by leaving reviews, tagging the studio, or following for updates and promotions.

17. Gift Cards and Loyalty Program

17.1 Gift Cards:

  • Purchase and Usage:
    • Gift cards are available for purchase and can be redeemed for any service or product at Pangea Ink.
    • Gift cards must be presented at the time of redemption.
  • Validity and Expiration:
    • Gift cards do not expire unless otherwise stated at the time of purchase.

17.2 Loyalty Program (Stamp Card):

  • The loyalty program allows clients to earn stamps for specific actions, such as:
    • Visiting the studio.
    • Following and interacting with Pangea Ink on Instagram.
    • Referring new clients.
    • Leaving a 5-star review on Google Maps.
  • Stamp Validation:
    • Clients must present proof of actions, such as screenshots for social media or Google reviews, to earn stamps.

17.3 Program Terms:

  • Stamps do not expire and may be accumulated indefinitely.
  • The program is subject to change or termination at Pangea Ink’s discretion, with prior notice given to participants.

18. Emergency and Special Requests

18.1 Emergency Situations:

  • For emergencies related to tattoos or piercings (e.g., infections, adverse reactions), clients should seek medical attention immediately and notify Pangea Ink.

18.2 Special Accommodations:

  • Pangea Ink strives to accommodate clients with specific needs or preferences, such as:
    • Private rooms for sensitive procedures.
    • Adjustments for physical disabilities or medical conditions.
  • Requests should be made in advance to ensure proper arrangements can be made.

19. Amendments to Terms and Conditions

19.1 Modifications:

  • Pangea Ink reserves the right to update or revise these terms and conditions at any time. Updates will be communicated through our website or other official channels.

19.2 Client Notification:

  • Clients are encouraged to periodically review the terms and conditions to stay informed of any changes.

19.3 Effective Date of Changes:

  • Amendments take effect immediately upon posting unless stated otherwise.

20. Acknowledgment and Acceptance

  • Artists have the right to decline requests for designs or procedures they are uncomfortable performing or that fall outside their expertise.

21.3 Client Disqualification:

  • Clients may be refused service if they:
    • Arrive under the influence of alcohol or drugs.
    • Fail to disclose relevant medical information.
    • Exhibit abusive, disrespectful, or inappropriate behavior toward staff or other clients.

21.4 Studio Rules:

  • Clients and accompanying guests must respect the studio environment by adhering to the following:
    • Avoid loud or disruptive behavior.
    • Supervise children if present.
    • Refrain from consuming food or beverages in work areas.

23. Waiver of Liability

23.1 Acknowledgment of Risk:

  • By undergoing any service at Pangea Ink, you acknowledge and accept the potential risks, including but not limited to:
    • Pain, swelling, or allergic reactions.
    • Infection or improper healing if aftercare instructions are not followed.
    • Potential scarring or fading over time due to natural factors.

23.2 Client Responsibility:

  • Clients assume full responsibility for their health and safety during and after the procedure.

23.3 Exemption of Liability:

  • Pangea Ink is not liable for complications resulting from:
    • Client negligence or failure to follow aftercare instructions.
    • Undisclosed medical conditions or allergies.
    • Adverse reactions to materials used (e.g., inks, needles, or jewelry).

23.4 Binding Waiver:

  • Clients will be required to sign a waiver before undergoing any procedure, releasing Pangea Ink and its staff from liability for any unforeseen complications.

24. Feedback and Reviews

24.1 Client Feedback:

  • We encourage clients to share their experiences with Pangea Ink by leaving reviews on platforms like Google Maps and social media.

24.2 Resolution of Concerns:

  • If you are dissatisfied with your service, please contact us directly to address the issue. We strive to resolve concerns amicably and professionally.

24.3 Public Feedback:

  • While constructive feedback is appreciated, defamatory or false claims made publicly may result in legal action.

25. Termination of Agreement

25.1 Right to Terminate:

25.2 Effect of Termination:

  • Upon termination, any outstanding deposits or payments will be forfeited.
